Litigation is a process of bringing an action in court to apply a specific right. Therefore, when an individual starts a civil lawsuit, that person starts the litigation process. Guided by the various rules of civil procedures that control actions in federal courts and state, litigation process involves a sequence of steps that may result in a court trial and probably bring a resolution to the matter.

Before filing a lawsuit, the person envisioning the lawsuit (referred as the plaintiff) normally demands the individual who caused the alleged damages or injuries (referred as the defendant), to take some actions that can resolve the conflict. If this demand is ignored and refused, the plaintiff can proceed with the lawsuit by serving copies of complaint and summons on the defendant and filing the complaint in civil trial court. The plaintiff must state the alleged damages and injuries and point them to the defendant and request an equitable relief or money to cover the damages. In most cases, the plaintiff is presented by a litigator in the court.

A litigator, on the other hand, is someone who has specialized in taking legal actions against organizations and individuals. A litigator deals with the big picture from the start of the case until it is concluded. A litigator starts with fully investigating the case and gathering every detail that might ultimately  affect the outcome of the case. A litigator can also employ the services of other professions such as accountants and private investigators.
